Resale of a fake Gucci bag is illegal in the United States. A counterfeit handbag is not a gray-market item. It is an infringing product. Federal law covers the seller, not only the factory. Federal criminal law
18 U.S.C. § 2320 makes trafficking in counterfeit goods a felony. Trafficking covers selling, offering for sale, and holding stock for sale. One bag can support a charge.

The first-sale doctrine does not help. It covers resale of genuine goods bought from the brand. A fake bag never entered that chain.
How resale gets caught

Platform rules
eBay, Etsy, Poshmark, Mercari, Depop, and Amazon ban counterfeit goods in their terms. Penalties include listing removal, loss of selling privileges, and permanent bans. The INFORM Consumers Act requires online marketplaces to verify high-volume third-party sellers. The FTC took over enforcement in June 2023.
Fake bags and real bags at resale
- Serial numbers and date codes change by era. A number alone proves nothing about authenticity.
- Dust bags, boxes, and care cards are copied, so packaging is not evidence.
- Authentication services check stitching, hardware plating, font, and leather grain.
Used authentic Gucci bags resell through consignment shops, auction houses, and resale platforms that run authentication. Counterfeit bags have no legal resale channel in the US. A listing that says "replica," "inspired," or "mirror quality" is still a counterfeit listing.
What happens to the buyer
Buyers who resell can be charged as traffickers. Buyers who keep the bag can lose it to seizure and have no refund path. Card chargebacks fail when the buyer knew the item was counterfeit at the time of purchase.
